Pet Medical Malpractice

My female Engish Bulldog died 2 days after giving birth to 9 puppies by C-section. The necropsy showed that the cause of death was caused by a rupture in the uterus that allowed fluid to leak into the abdomen causing a massive infection.

She started getting sick about 12 hours after giving birth. I took her back to the vet, and he treated her for hypocalcemia (milk fever). He never peformed any test to determine what was the cause of her distress, just started treating her for milk fever due to the symptoms she was displaying.

She got a little better for a few hours, but started getting worse agan. I called the vet several times to report on her condition (that she was not getting better). Every time, he told me to keep treating her for milk fever. I even had to return to his office for more medicine. I kept giving the medicine to her, but she kept getting worse. By this time my vets office was closed, so I decided to take her to an emergency vets office.

When we got there, just as they usered us into the exam room, she collapsed and died. After the necropsy, the emergency vet told us that had we brought her to them initally, they would have performed a battery of test to determine what the cause of her distress was.

Unfortunatley, one of my first jury trials was such a case some 30 + years ago. I was the new associate who tried such cases. Jury awarded 20K, but judge reduced the award to the market value of the dog. That is the law.

There is little value to an attorney to handle such cases. By the way, I have four dogs and love them.
