Legal Question in Personal Injury in Florida

in Florida, if you have settled a partial insurance claim(my homeowners policy) due to damages caused by persons ripping up property (trees, bushes, ground cover) can I sue the responsible party for the unpaid damages?

Probably not. It depends on the release you signed and the subrogation rights you gave to your insurance carrier.

If you resolved with your own insurance and there are non covered expenses you likely can pursue negligent or intentional act parties. If you signed a general release with your insurance you may have waived the claim. Review all papers with an attorney
