Legal Question in Personal Injury in Florida

I was hit by a drunk driver who had no insurence, and he jumped out of his van and ran!! Their van was totaled that night, and my Jeep the next day with the same company. I don't have full coverage so a rental car is needed to get back and forth to work, pick up kids, ect. I have to make HIM pay for it, I didn't do anything but park on the side of the road! Filed a claim with my insurence but I'm only going to get a check for my vehicle. How do I make this guy pay?! He hit me at 4am (I was legally parrell parked) and tried to drive away but his van was ripped up and couldn't make it one block down... is a lawyer needed or should I expect my insurence company to go after him?

Do not count on your insurance company to do all that could be done to protect you in this case. You need to have an advocate who understands Florida insurance law and liability. Hire a lawyer.

Make sure he and the owner of the vehicle have no insurance. Because he was the driver does not make him the owner. Also, no insurance means "no" insurance, as opposed to no BI but yes to property coverage. I assume that there is no personal injuries involved, so you may have to pay a lawyer to investigate this properly, but my guess is you may be spining your wheels.
