Legal Question in Personal Injury in Florida

slip and fall

my mother fell in the premises of my home and broke her arm, as a consequence of her fall, she hit her head causing her to experience severe migraine headaches. She has no medical insurance and neither do I? I have home owneres insurance? Can she sue my insurance and acquire compensation due to the injury that she suffered?

You failed to indicate the cause of the fall. If it was your fault she can sue you. Your homeowners insurance will cover you.

She cannot sue your insurance company, but she can make a claim against you (the homeowner) and your insurance company may cover the claim and pay her money to settle it depending on where she lived at the time of the fall, the cause of the fall, and other factors that need to be explored before any lawyer can provide you with any meaningful opinion you can rely on. DESPITE THE FACT THAT SHE IS YOUR MOTHER the same principles of law apply. Was her injury caused by some defect in the premises or was she careless and her fault. You may have medical payments coverage on the policy which pays regardless of fault.
