Legal Question in Real Estate Law in Florida
To who this may concern,
I have a question regarding pets. I was talking to a woman recently and the woman had told me that she went on vacation and hired a dog sitter to watch her dog for her while she was away, when she got back her dog was no where to be found, the dog sitter had turned the dog into the SPCA claiming the dog was his. The SPCA did not scan the dog and when the true owners went to try reclaiming their dog, the dog had already been adopted. The SPCA stated that they do not scan dogs that are "owner relinquished" and this dog was not relinquished by his true owners but by the dog sitter. Is this legal? The SPCA also refuses to contact the owners that adopted the dog and refuses to give the true owner any information about who adopted the dog so that they can attempt to regain their beloved pet. Is what the SPCA is doing legal? Is their anyway to regain the dog?
Any information would be helpful and greatly appreciated.
Thank you for your time.

Sounds like the dogsitter is liable. the local ASPCA may have some liability as well. They should consult with an attorney as soon as possible to review their rights.
