Legal Question in Real Estate Law in Florida

donating or selling half a condo

I co-own an inherited condo with my brother, via a warranty deed, as joint tenants with right of surviveorship. Can I donate my half to a charity or sell my half without his permission? What then happens to financial ''reimbursement'' he's demanding as a condition for selling the condo, most of it unwarranted?

If you do not agree, then stop right here, and do not read any further.

You have the right to do whatever you like with your half although the transferability is limited based on it only being a half interest in the property. Certainly, you can donate that interest to a charity if you like.

I have no idea what you mean by the financial reimbursement your brother is demanding. Perhaps it is for expenses to maintain the property during the pendency of the probate. You need to discuss it with him to get more information.
