Legal Question in Real Estate Law in Florida

foreclosure/florida

I was served with a mortgage complaint foreclosure.

First, they lost note and are trying to re-establish;

Second: They claim I have not made payments since November, 2008, I have proof of western unions made to mortgage servicer;

Third: The mortgage broker that handled this loan practiced predatory lending, failure to disclose documents until time of closing and fraud on the application, which I signed under protest in front of notary who closed us in our home.

How do I fight this complaint???

Re: foreclosure/florida

Payment is usually a good defense. If you are correct regarding payments, and there are not other issues involved, you may have a right to attorneys' fees.

You should find an attorney experienced in litigating foreclosures.
