iam 3 months behind with my mortage payment but still making payments can the lender forclose on me i have already had a loan modification

If you are 3 months behind, yes the lender can foreclose. Communication is key, if you are having trouble making your payments you should contact your lender to discuss your circumstances as soon as possible.
