Legal Question in Real Estate Law in Florida

Real Estate question and a question on when someone is subpeona'd

Can you tell me how long before you have time to catch up a mortgage before they can foreclose on your home?

Also,

If you fail to appear in court after your subpeonad but payed what is owed thereafter what are the penalties? Can you be arrested? Please let me know.

Also, how long before a Homeowners Association can place a lien on your home?

Thanks,

Sandra

Re: Real Estate question and a question on when someone is subpeona'd

Without reviewing the foreclosure action filed against you, review of the supporting documentation (mortgage, note, etc.) underlying the foreclosure suit and interviewing you to learn all the facts surrounding your case, it is impossible to answer your questions. However, I can tell you that generally defendants in a foreclosure action do not get arrested for disregarding a subpoena. You should not disregard hearings, subpoenas, court orders or any other matter associated with your foreclosure case. Seek the advice of counsel and good luck.
