Legal Question in Real Estate Law in Florida

right of first refusal not given

In a commerical rental, when you have the right of first refusal on a store what are your options if the landlord rents it to someone else without disclosing the terms and allowing you the right to the first refusal?

Re: right of first refusal not given

Any advice must be first preceded by a reading of the lease. Thereafter, it must be determined if you had, in fact, a real need for the space. That means if yours were offered, you would have acted to exercise the right. If you would not have done so, then you sufferred no damage.

You shoul consult with an attorney for further determination. My voice number is 305-940-8080.
