Legal Question in Real Estate Law in Florida

Renter in Foreclosure

My landlord said he does not have my $2,000 deposit and is in the process of doing a short sale. I need my deposit to move. How can I get my deposit back before he forecloses?

Re: Renter in Foreclosure

Your only solution may be small claims court. A short sale does not mean that your deposit is gone. Just because he loses the house doesn't mean he still doesn't owe you the deposit. In fact, you may be able to sue quickly and put a lien on the house before it sells. When it sells, your money will have to be paid as part of the sale.
