Rodent Problem

We closed on our house on April 26,2001. On June 19th we had to cut a hole in the wall to find out what was causing a foul odor. We found a dead 4-5'' rat. Had pest contol out on June 20th. The pest inspector found another dead rat and found evidence of more (# not known). The inspector said the rat problem had to be known by previous owner because there is evidence of poision. My question is did the previous owner have a duty to disclose the problem before closing? Can we ask for reimbursement for pest control expenses?

In Florida, the seller does have an affirmative

duty to disclose material defects that

substantially impair the value of the house

which they knew of should have known about.

Nobody can assure you that you would win.

The only way to get a definite answer is to file

a lawsuit and present all the evidence to the

judge and jury and see what they decide.
