Legal Question in Traffic Law in Florida

On March 10, 2010 at 12:00 am, I was driving in Panama City Florida. I was the designated driver with 2 passengers over the drinking limit in the vehicle. The vehicle is a 4-door 2006 silver saturn. One of the passengers sat on the window, I pulled to the side and got him back in. When I started to drive off a local police officer pulled me over only asking for my license (not registration or proof of insurance). He went to the police car and checked my perfect record. I have never gotten into trouble and I was being a very reliable person taking my friends back to the house. I thought I would have gotten a warning. Instead the police officer gave me a $160 ticket. Along with the ticket he got details on the vehicle wrong. He said it was a 2007 2-door silver saturn. Along with those two mistakes and him not asking for registration and proof of insurance, the ticket should be thrown out right?

To be blunt, not it does not have to be thrown out. The officer does not have to ask for registration or insurance. He only has to make sure that the driver is who he says he is by checking your driver's license. The officer has the right to amend the ticket up to the moment of the hearing and even if he didn't it is likely the judge to deem the year and the number of doors to be insignificant. Your best chance to beat this is to hire an attorney in your area that is knowledgeable in traffic law. Good luck.
