Legal Question in Wills and Trusts in Florida

Dad's bank account

My father went to his bank before he died and signed a paper that stated that upon his death, his bank accounts should be closed and the monies in them divided between his four daughters. --name removed--mother is already deceased. --name removed--question is this -- if we bring his death certificate to the bank, will they close the account and disperse the monies to each of us or will they freeze the account until his will goes through probate? I have one sister who wants to keep all the money to herself. There is about $20,000 in both accounts. What should I do? --name removed--father died November 24th. Should I go to the bank with the death certificate or allow--name removed--sister (who is the executer of his will) to ignore his stipulation and use the money which she has access to? Thank you.

I doubt the Bank will honor any letter of instruction.

Re: Dad's bank account

It sounds like your dad added the four names as beneficiaries on the account(s). If so, the bank will divide it (them) in equal shares among the four of you, no matter who approaches them first. The probate court should have nothing to do with it.
