Legal Question in Wills and Trusts in Florida

My father passed away and I understand he had set up a family trust but I do not have a copy. He died in Orange Springs Florida. How can I get a copy?

He was retired but had a company JP Kennels which ceased operation when he died.

Unfortunately I do not have anyone I can contact that could give me any information.

Is there any place I can contact to research this information and obtain a copy?

A revocable trust is not required to be filed in public records; however, after death of

the grantor, a notice of trust is filed in the appropriate county. The trust should designate

the successor trustee. Interested persons such as beneficiaries may request a copy

from the trustee, or, if necessary, in probate court. An attorney to represent an interested

person may be necessary.

With the trust not being filed which is why you are asking, try looking at the incorporation of his buisness. Was the incorporator an attorney - if so contact that person to see if any further dealings with him/her. Look at the names of the directors etc. see if there is an address you can contact them with and see if they have knowledge. Who is living in the last residence of your father - check the tax records to see if the house was in the name of the trust. If so, then you can force the spouse to file the Notice of Trust and then perhaps force a reading of that trust.
