Legal Question in Wills and Trusts in Florida

Intestacy Distribution

My son is the decedant. My exwife is the personal representative. There are two children. My son was divorced.

I told my ex-wife our son owed me and my current wife $2000. She wants me to sign a waivor for the $2000.

Under Florida law, am I entitled to part of the estate besides the debt ?

She would love to exclude me entirely.

If there was no will the chiidren inherit. A guardian must be appointed for them. You may make a claim against the estate as a creditor.

File a CLAIM against the estate as a creditor. The estate cannot be closed until the claim is released. File a DEMAND FOR NOTICE so you are on the mailing list to receive copies of all court action. Go to the courthouse and inspect the probate file yourself, i.e., in person. More questions, feel free to contact me: 866-Law-Easy. We are in Stuart, Florida.
