Legal Question in Wills and Trusts in Florida

My mother was beneficiary on my Great Aunt's small life insurance policy. They are both deceased. I need to file a form with the court to claim the money without opening and estate or going through probate. 1. What form do I file? 2. Can MY creditors take the money once I file?

The form you need to get from the court is through probate. If your mother died over 2 years ago, or the amount is under $25000 you need to do a Summary Administration. You will need a lawyer for this.

Creditors can take the money if your mother owed them, unless she has passed away more than 2 years ago.
