Legal Question in Wills and Trusts in Florida

If my mother had a will and it was recorded does my stepfather have to honor it - example = if he re-marry's he is to sell the house and give the children their share...

or if he chooses to sell the house he is then to give the children their share...

The terms of the will cannot be arbitrarily ignored by your stepfather. However, there are homestead issues regarding real estate that affect the terms of the will. You need to consult an attorney, provide all of the facts and circumstances and let that attorney assist you. I would guess that doing so would involve a minimal amount of time, and thus would be reasonable in price.
