mother with no will,stepdad incarcerated and remarried

my mother died 3 years ago,leaving no will.stepfather distributed nothing to any of the three children.stepfather is now in prision for 25yrs-life.his new wife is occupying the home that was purchased by mom's family inheritance. do my siblings and i have any rights to her home,or estate-even though there is no will?

Yes, property in your parent's name, without a will, would be disributed with the first $20,000 in value going to your step parent, balance split between step parent and children. There are also homestead issues.
