Legal Question in Wills and Trusts in Florida

My stepfather passed away in November and left my mom with nothing. They did not own a house and he had no life insurance or any assets. We've closed all of his accounts but we just got a check for $200 made out to the estate of..Our credit union won't cash the check for my mom and the creit card company won't reissue it in her nameEveryone says we need a letter stating he had no estate. On top of that, he was hospitalized a week before he passed away and we have gotten over $75,000 in hospital bills also to te estate of. He had no medical insurance either and we beliee the hospital released him early because of it. He passed away 3 days after being discharged. My 2 questions are 1 - how can we get a letter stating he ahd no estate and 2 do we have a potential case against the hospital?

Depending on the amount and nature of his estate, you may contact local probate office or attorney to apply for summary administration or disposition without administration. E.g., if the assets do not exceed medical and other final expenses up to $6,000, you can obtain a disposition without administration. Regarding the legal action against the hospital, you are

advised to discuss it with an attorney experienced in medical litigation.

Just so know - if you file for the Disposition without administration - the fee is $231.00. So much for the $200.00 check. However if you have an issue as to medical malpractice - I suggest you contact an attorney who specializes in that field. There is usually no fee up front as consultations in those cases as free. RUN before you lose the opportunity to sue.
