Legal Question in Wills and Trusts in Florida

right of survivorship

My sister has been Dad's caretaker and is executor of his estate. He gave her the condo and now she feels the majority of his estate is hers to keep, with only a small portion going to me. Her attorney says the will is null and void and she has right of survivorship. She will not show me the will. The estate is in Broward County, & I live in Manatee County. Do I have any rights to a fair share?

Re: right of survivorship

All wills must be filed and are public record. You should demand to get a copy of the will. contact the attorney. You can bring an action to force the filing of the will. If shge has begun probate, then you can see the will in that forum.

jointly held assets will pass to her outside of probate.
