Legal Question in Bankruptcy in Georgia

Chapter 13 Stay Lifted

Can you stop a Chapter 13 stay from being lifted and your house going into foreclosure? We are only 3 months behind and didn't know it and can get the money to catch up. If not can you turn a Chapter 13 into a Chapter 7?

Only your attorney can answer you. We've never seen your pleadings and information. Since he's being paid to answer you, ask him.

Re: Chapter 13 Stay Lifted

You may have grounds to oppose the motion to lift the stay, particularly if you were not aware of default, and have the funds to cure. You may have to agree to a "strict compliance" order, under which you are required to remain in good standing, on penalty of immediate lifting of the stay.

You should consult a bankruptcy attorney to protect your interests.
