Legal Question in Bankruptcy in Georgia

Default

I defaulted on my chapter 13, aprox. 3 years ago. Now I am getting phone calls and harrassment about garnishment.

What can i do?

While refiling your case is an option, I would also suggest that you may have an opportunity to negotiate a favorable settlement with your creditors. From the creditor's standpoint, your debts are old and you were not successful in sustaining a Ch. 13. If you were to approach your creditors, one at a time, and offer 10 to 20% to settle your debts, you may find that one or more would take you up on the offer.

Your choices are probably the same as they were 3 years ago - pay the debts, or file for bankruptcy. Calls and "harassment" are to be expected as creditors want to collect the debt owed to them.

You may be able to file a Chapter 7 or 13. Go to www.glenashman.com and get a free worksheet from my office and when you complete it, I'd be glad to review it for you. Both chapters are more complex than they were 3 years ago, but one or both may be an option.
