FIFA Garnishment

My bank account (with money in it)was garnished about a month ago due to a FIFA/judgement. I am filing a straight Ch.7 in a couple of weeks. Will I get my bank account and my money that was in it back? Will my future employment earnings be garnished post-filing? Thank You

Only the attorney handling your bankruptcy can answer that, but you need to file the bankruptcy in most cases less than 30 days after the garnishment being served in order not to lose the funds in your bank account.

Funds taken by garnishment within 90 days of the bankruptcy filing may be recovered by a proper application to the Court. Do not try to do this without the assistance of an attorney.

Post-petition earnings are not subject to garnishment. However, if it turns out that you do not qualify to file Chapter 7, you may have to pay over part of your income under a Chapter 13 Plan. You should consult an attorney to make sure you qualify.
