Legal Question in Bankruptcy in Georgia

Relinquish rights to time share in Chapter 13

Released time share back to owner or finance company when filed Chapter 13 last year. Time share payment was not included in payment due to giving it back. Did a voluntary dismissal early this year. Receiving threatening calls from collection agency regarding time share payment plus interest. What is my financial responsibility? I assumed that since we relinquished all rights to the property and released all rights , I would not be responsible a year later. Please advise.

Read your contracts and related documents. Do they provide that you can surrender the property without further financial liability? That would be a very unusual provision. Otherwise, on what basis do you "assume" that you have no further liability under the contracts you executed? I can't be the bankruptcy, since you dismissed the case without a discharge.

As I am sure your attorney in the Chapter 13 advised you already, you likely are assuming wrong. Your best source of information would be your lawyer from that case.
