buying a dba from a corp

can i buy an italian restaurant from italian restaurant inc? or do i have to purchase the whole corprateration?

Maybe. Whether it is a good idea is a different question. It would be negligent and shortsighted for you to enter into such an important financial transaction without qualified legal advice. A lawyer experienced in the sale of businesses will review with you the differences between a purchase of assets, purchase of the entity, or other scenario.

Assuming Italian Restaurant, Inc. owns the rights to the name "Italian restaurant" and it is even a trademark-able name, then, yes. You can buy the rights to the name without purchasing the company.
