Legal Question in Business Law in Georgia

In June of this year 2009. I was laid off from work.

I had 7 years with this company and was a supervisor for the last 5 years of that 7 years. I had the least years of service in the company not a big deal so I thought.

This week they had another lay off and another supervisor who had the least years of servise with the company didn't get laid off because he was a supervisor.

Now my question is. How is that fair to me when they said that they were going by years of service in both lay offs, but in his case they said he was not included in the lay off because he was a supervisor?

So is there anything I can do about this?

It appears that they have a rational lay off policy. You had the least amount of experience as a supervisor and was laid off. Companies normally don't group different tiers as one. Therefore, you cannot compare the treatment of supervisors with the treatment of lower level workers.

Moreover, the next layoff may not be based on senority, but competence and output. Additionally, because Georgia employees are at will (in most circumstances), they can fire people for any reason that is not discriminatory (sex, race, religion, etc.).
