Legal Question in Civil Rights Law in Georgia

Death threats civil or criminal?

My friend has received death threats and threatening phone messages from her husband's ex-wife. There have been on-going custody & visitation disputes, but the ex-wife was deemed unfit due to poor care of the children & drugs use.

Tonight there was a dispute over the ex-wife picking up the children for a visit. The ex, while on her way to my friend's telephoned her and said she would find her in the dark and beat her to death. My friend phoned the police immediately. When they arrived, Police told the ex-wife that she had to leave the property, and she did. Then the phone messages began. There are 7 recorded messages and each one is more chilling than the last. My friend is extremely frightened, and she doesn't know where to begin to try and protect herself and her family.

Most assuredly her civil rights have been violated, but when does it become criminal in the eyes of the law? After she is harmed? Please answer as soon as possible.

Thank you very much.

Re: Death threats civil or criminal?

This is most certainly a criminal matter. Call the police again and turn the recordings over to them. This is a matter for law enforcement and not a private civil attorney.
