Can a probate settle an estate without the rightful heirs being established? Grandfather made a will 1968 name the 2 boys heirs if my grandmother died. When she died, she had raised 5 childern and adopted one. One boy is dead and the adopted son is living. The living girl she raised when to worked to take over everything. Emptyed bank accounts, file a lawsuit as a friend at first got a lawsuit never contact the the adopted son. She claimed virtual adoption after mom died. It's been 5 years and the probate court said they were going to divided it but the rightful heirs were never established. The lawyer my uncle had mailed him a check, never stood up for him. Wants him to take it, TELL ME, where does he stand?

Your post makes little sense. No one can possibly tell you where anyone "stands" with virtually no facts, no documents, etc. Since it is a pending issue in court, and there are disputes, anyone who has an interest should get a lawyer to answer these questions.
