How do I break a construction contract ?

The builder we signed a contract with is doing a terrible job. His sub-contractors don't show up when they say they will and a large majority of the work they have done needs to be redone. It is coming up on 10 monthes and our house still does not have all the windows in the the framer is still working on areas. The builder also did a bad job on his estimates, so he is already losing money on the house.

We feel this is the reason he is dragging his feet so much on completing things. After we get caught up, is there any way to get out of the contract?

The only way to legally terminate the contract is to terminate due to the other party's breach. If the builder has breached terms of the contract, you may then terminate the contract as a whole. However, you must make sure that you give full and proper notice if you do terminate in order to avoid any breach of contract allegations on your part.
