Legal Question in Consumer Law in Georgia

Garnishment without consent

Can a satellite company remove money off of my debit card without consent? The company has my card on file from a previous payment and decided to remove the amount themselves since I was 2 mos. late. However I have not signed or agreed to any contract with the company. Nor did I request automatic payments from my account. They sent me a statement in the mail that '' for your convenience'' we will remove the money off of the card we have on file for you. The statement was dated August 30. I did not receive the statement until Sept. 6. and they requested the money to be removed during labor day weekend on Sept. 2. Which gave me a total of three days. I was charged a substantial amount of money which caused my account to go into a huge negative balance which cost extra fees on my Rent along with my banking account in total excess of over $300! Help me!

Re: Garnishment without consent

What did you agree to when you initially provided the account number? Most likely, you did agree to certain terms when you did so and it MAY have included consent to a future draft. Call and ask them on what authority they did so. Beyond that, you do in fact have an agreement with them - the agreement to pay the bill on time.
