Legal Question in Credit and Debt Law in Georgia

Deceased Mother's debts

My mother passed away in September. She had no assets as they were sold to keep her in a home. When all the money was gone we used her SS to pay and we made up the difference. Now she is gone and the hospital, pharmacy, home, Doctors are all calling wanting us to pay all the debts. We paid the funeral bill but don't feel we are responsible for anymore debt. We are well off but I don't want to spend my retirement to pay her debts. Do I have to? Can I send these bills back to the people marked ''DECEASED''Will this work?

Re: Deceased Mother's debts

Heirs have no liability to pay the deceased's debts (they also can't inherit anything in this case as creditors come first). If there are no assets and no probate, send a letter to the creditors that says "Ms. X is deceased. enclosed is a copy of her death certificate. There is no probate and no estate, so there is no one to contact about paying any debts. You may not contact me or any family members further since we are not co-signers and have no obligation."
