Legal Question in Criminal Law in Georgia

My brother was unable to secure an auto loan for himself so he asked me and my mother. Both me and my mother were able to secure an auto loan for him to purchase a vehicle. He was paying until several months ago and I have had to pick up payments due to him failing to pay on the car. He has left the family home and took the car with him and we are now unable to contact or locate him. The car is in my name as well as the license plate all registered in my name. what can I do legally to recover the vehicle that he has taken and fails to pay for?

It sounds like you (and your mother) committed a fraud against the car lender, unless they knew and you told them in the paperwork that someone else would be making the payments and driving. That puts you in a very precarious position. Before you get in further trouble, see a lawyer.

Either find him and work it out, or take the risk of finding him and going and getting the car. Either way, a legal action is highly unlikely to end up with a good result. This was the risk you took.
