Is it a crime if you are dating someone 9and has been intimate in the pass)and you say no and try to fight him off but he over powers you and committs non-consenual sex?

Despite your prior consensual intimacy with this man, the later

non-consensual sex is considered rape because it was 1) by force, and 2) without consent. Note that a man can even be charged with raping his own wife. You need to seriously consider reporting this incident before the case is further compromised by time.
