Legal Question in Criminal Law in Georgia

Twin Brothers Arrested for Fighting

Several weeks ago my sons were fighting in my home, I paniced and called 911. To my surprise and horror they were arrested and charged with criminal tresspassing and something called (Afray) I begged the officer not to arrest them. I only wanted a mediator. I did NOT press charges but, he arrested them anyway. They now have to appear in state court for a fight that lasted under 2 minutes. Is there anything I can do on thier behalf to fight these charges? They are 18, in school and one son has a job. Niether has ever been in trouble with the law, not so much as a traffic ticket. For that matter niether has ever been in trouble at school. They are good boys and I feel like such a bad mother for picking up the phone.

I have no money to help defend them.....Please Help.

Re: Twin Brothers Arrested for Fighting

Do not panic. Your actions were correct in the situation. Your boys have to learn they cannot settle disputes with violence. It is the job of the police to quell disturbances, and the manner in which they do so usually involves arresting one or both parties involved. The offenses they are charged with are misdemeanors. When they go to court, make sure the Public Defender (if they have one in Hall County) knows they have no record. There should be a "Pre-Trial Intervention" program there for people who have had a one-time lapse in judgement. It usually consists of classes and community service of some kind. Upon successful completion of the program, your sons' cases should be "dead-docketed" or placed in "nolle prossequi" status. Please give me a call if you wish to discuss the matter further.
