What is the statute of limitations for filing an Age Discrimination complaint before the EEOC in Georgia?

Georgia has no state agency to handle such claims, so they must be filed with the EEOC. You must file within 180 days of the discriminatory action.

I happen to practice law in Florida. In Florida you need to file a Charge of Discrimination with the EEOC within 300 days of the discriminatory act. There are some states with a shorter statute of limitations and in those states you have to file within 180 days. The difference depends on if your state has a local FEPA, fair employment practices agency, operating within the state. Check with the EEOC office in Atlanta. The EEOC web site, www.eeoc.gov, has general information on filing a charge, as well as, information to assist employers comply with federal anti-discrimination law. You should also be aware that some state laws have a longer statute of limitations than the federal law enforced by the EEOC.
