Legal Question in DUI Law in Georgia

My name is Leon. I had a DUI arrest on July 20, 2011. I was pulled over for a speeding violation. As soon as the officer stopped me and approach the car. He asked me had i been drinking before I could roll down my window to talk with him. I had a female passenger in the car at the time. He told me to get out the car he shined a flashlight in my eyes. No field sobriety test was conducted. I told the offices I had not been drinking. He gave me a breath analyser test about 3 times and it didnt read. I told him i was type 1 diabetic that why my eyes was read and its needles in my car. Next thing that happen he said he was going to place me under arrest. I was put in a second police car while the first officer talked to the female passenger. He ask how did she know me. Who is he and do you have any drugs in your possession. While this was going on I counted to 1-20 said my ABC to the second officer he said i passed but I was taken to the police station. We got to the police station. The first office made be go to the back of the police station to take another breath analyser test. I blow in it nothing happen then he started pushing me and cussing me out then he told me he charging me with dui and refusing to use the breath analyser. I have a court date DEC 5, 2011. What do I need to present to the judge about my case. I never been arrested before either.

Hopefully you hired a lawyer less than 10 days after the arrest. If not you already missed one very important deadline, the ALS hearing.

In the unlikely event you have not yet hired counsel, get a lawyer before your court date and do it today (you have waited far too long). A layperson is not going to know how to present a DUI case, and how to minimize the damage from a bad outcome.
