Legal Question in Family Law in Georgia

Abandonment

A friend was in the process of seperating from his wife when she went to see a "shrink". The Dr. gave her a letter to give him stating that if he left her while under psyicatric treatment that he would be charged with abandonment and have to pay alamony. Is this true? If so is there any way around this? Thank you.

Re: Abandonment

This is not necessarily true. Whether or not a person's spouse is under phsychological or psychiatric treatment does not, as a matter of law, entitled the spouse under treatment to alimony.

Adandonment, generally speaking, only applies in cases in which one spouse leaves the other and refuses to pay child support for the parties' children.

With additional facts about the situation I can be more specific about what this person's options are and what they can expect should they separate from their spouse.

I may be contacted by phone or mail to arrange for a free thirty minute consultation.
