Legal Question in Family Law in Georgia

Age detirman Visitation

In the state of Georgia , can a child over 15 yrs of age decide for herself if she will visit or not? My ex has told me that my daughter (15 yrs old ) does'nt have to come if she does'nt want to ... is that true?

Re: Age detirman Visitation

No. Not if the order says the parent is entitled to visitation. At that age, she is entitled to be heard in a divorce proceeding on the question of custody, but that does not mean she has the right to refuse to visit the parent as provided by the decree. Until 18, she is subject to the authority of her parents on these points. The custodial parent is incorrect in her statement as put, and if she is backing the girl, she is contempting the court as it could view her as interfering by telling the daughter such things and inciting her defiance. If the daughter was just being recalcitrant and the custodial parent was trying to get her to go, the situation would be different, because it is hard to force a teenager to do anything.
