Legal Question in Family Law in Georgia

I was awarded $35,000 in my divorce settlement. My ex made the check out to my lawyer not me. Now my lawyer is holding the money until we go back to court to see if I can get my legal fees paid. I have already paid him $50,000 but still have a balance. Can he keep my money from me?

A lawyer generally has a lien on funds recovered. Do you not want to pay him? You need to discuss this with your lawyer, and not go to the internet.

You've already asked the same question on another Internet site and received two excellent and accurate answers.

You left out here the sentence which matters - that the court had reserved the issue of attorneys fees for another hearing.

Anyway, the answer is the same. If the attorney has filed a proper lien, and your fee agreement permits it, he can hold the funds. If not he cannot. If there is a dispute over this, you should, as you were already told elsewhere, contact the State Bar of Georgia fee panel for assistance.
