Legal Question in Family Law in Georgia

child visitation in georgia

My son was awarded standard visitation with his on. He has his son this weekend, and Monday is his holiday. When he called the mother today about picking his son up, she told him that the son could not spend the night Sunday night or Monday night. We are confused on how these 1 day holidays are suppose to work. Logically, if you have the child for the weekend, it would seem that you would just keep the child the extra day for the holiday and take him home Tuesday AM. But is this the legal way this is suppose to work? She has threatened to have my son arrested if he does not bring his son home by 6:00 pm on Sunday night. Can you help answer this question?

Re: child visitation in georgia

It depends entirely on the language of the order or agreement in the case. Every agreement or order is different, even with so-called "standard visitation." Your son should immediately review the order with an attorney to get the answer rather than taking a chance that he might be wrong in his interpretation.
