Legal Question in Family Law in Georgia

childrens rights

What is the age that a child will be listened to by the court on not wanting to see a biological father who they are very unhappy being around? My children are 10 and 11 and they are miserable any weekend that they have to see their biological father and they always ask me why they have to go when they don't want to... (the father lives in Alabama..don't know which state laws we would have to go by either)Thank you for your time.

Re: childrens rights

A very good way to risk losing custody is to try to convince a judge to limit visitation. I'd suggest that you sit down with a lawyer and find out the ramifications of your question. Most judges routinely do not talk to children that age, but it depends on the judge and the case.
