Legal Question in Family Law in Georgia

Ok this is a little complicated but I have 2 kids with their biological father and then I got married to my now husband well we divorced and now we are back together. I was wondering if my now ex husband can adopt my 2 kids from my previous relationship even though we arent married anymore. My kids biological father owes me 21,000.00 and has not paid nor does he see my kids. Or do I first need to file abandonment on my kids biological father first.

Your ex-husband can't adopt your children unless your parental rights, and the father's are terminated. If you marry him, he might be able to do so. Talk to a lawyer to determine a course of action.

Marry him. Have the biological father terminate his parental rights. Then have your new husband legally adopt the children. Abandonment charges are irrelevant for these purposes.
