Legal Question in Family Law in Georgia

My daughter's father (we were never married) refuses to work or pay child support. I can't use the local child support enforcement agency because we (he and I) signed a waiver a while back that prevents me from using that agency for 36 months. We have not had a formal custody hearing and I was wondering if the courts would automatically grant me full custody if he is unemployed. He is living with his parents, would their income/assets be taken into consideration despite the fact that he's 31? And if I have documentation (police reports) stating that he is violent and abusive, will they deny him visitation? Thanks

Unless he has ever legitimated the child, he has no custody or visitation rights,

And unless you have left out something very unusual, the state cannot refuse to allow you to use their services.

See a lawyer to determine what you need to do with support. Visitation as I noted is not an issue at this time.
