Father ignores ''behavioral cause'' in Court Order

Our Final Decree court order reads ''Neither party shall have any unrelated person of the opposite sex as an overnight guest in the same residence w/the child while that party has physical custody of the child. Neither party shall possess oruse illegal substances and shall not abuse alcohol or be impaired while having physical custody of the child.'' Our only child/daughter is 4-1/2 YOA. We have lived seperate 1 yr; Divorce was final 9/2/04.Seperation & divorce was was on the ugly side.As months have passed we have gotten over some of it and are now civil/friendly. Problem:He has girlfriend (GF) that is sleeping over when child is there. She comes home and tells me, she doesn't know what that means, she is just telling me about her weekend @ Dad's. I do like this one bit. Children learn what the live and I don't want her to think that it is okay. I understand that he is an adult and can sleep w/whoever he choose, when or where - EXCEPT when he has our child. He has PLENTY to time for himself. I am torn as in what to do; rock the boat that has finally started sailing smooth between us, somewhat, or say something to him? I am sure he drinks as well, because I know him. I didn't want this divorce. Should I file contempt of Court?

I can�t say whether, considering all the circumstances, you should file for contempt. At the very least I think you should confront him before taking such action and consider what type of relationship he has with this woman. Legally, he is in violation of the decree and can be held in contempt. Whether that is the right decision is up to you.
