How can I gain custody of my neice?

My brother had a baby out of wedlock a few years ago. Although no paternity test were given, the child was accepted as his. The lady that he had the child with is not ''stable'' she has six other children who are not well kept, she moves frequently, she has no job, she was on psych meds, and she has problems from dfcs. Although my brother is in prison, the baby has a great support system. Whenever the lady get mad with someone in the family she takes it out on the child, physically and emotionally by not letting her visit us. Can we, the sisters or grandparents, petition the court for custody of the child?

You can petition the court for custody, but you will have to show that the biological parents are unfit parents, which can be difficult. Courts will normally not sever parent's rights without good cause.
