guardianship carried from one state to another

I have a three-part question regarding an 11 year old niece that I have had legal guardianship of since she was 2 months old. I'm about to move out of State.Her mother nor father has not shown input or interest in her life what-so-ever. I was told that I need to get a court order...before we make the move.how do I do that and will the guardianship still be in effect in the State of Georgia? I also wanted to change her last name legally. Will she still be entitled to State benefits since our relationship is still as a guardian? I am looking into adopting her but right now it is too expensive for me to consider at this time.

You would file a motion with probate court requesting permission to move out of the state. Notice of the motion would have to be served on the parents. You should state clearly the reason for moving. That is employment, family etc. Then when you arrive at the new state check with an attorney about the necessity of obtaining a guardianship in that state. If you adopt the child you will not be eligible for public assistance, unless you are destitute.
