Legal Question in Family Law in Georgia

I married and together my husband and I have 3 children. I want to leave the state of Georgia with my children and move to Washington due to a job. There is a lot of verbal abuse in the house and its better that we separate. Can I legally bring my children with me?

What will happen when a Judge orders you to bring them back? How will that affect the children? No one here can speak for a Judge in a divorce or custody case, so whether or not you are able to pack up the car and take them now it does not mean you get to keep them. See a lawyer and handle things properly.

Why would you think you have more rights to the children than your husband. Right now, unless a court says otherwise, he has the same rights you do, and should he balk, for at least six months after you leave, a Georgia court can compel the return of the children. Since courts abhor separating a child from a parent, especially a move that far, you risk actually losing custody. See a lawyer, sort things out, and then determine what actually works. I suspect your plan, absent having your husband signed up and a court okay it first, is destined for disaster.
