my husband is in the state penitentury for physical abuse towards me, our vehicle is in his name can i legaly sell it by signing over the title?

No, unless he has given you a written and signed power of attorney to sign things on his behalf. Another alternative is to file for divorce and ask the court to award the car to you in the divorce case. Then, under the authority of the court order, you could sign the title when you sell it.

Not unless you want to join him in jail.
If you divorce him, and if the court awards it to you (and it's paid for), then you could.
