Legal Question in Family Law in Georgia

What happens to a parents custodial rights when she goes to jail? Current order is joint physical/legal. Mother will be in jail for eight months. Father wants to file for sole legal custody, and modification of the 50/50 visitation.

A lot depends on (a) the language of the order and (b) the reason for the jail.

Step one would be to meet with a lawyer to assess if it is appropriate to seek modification.
